HB overpayment recovery from Council Tax account

I have a client who has just been granted an SMI exemption on their Council Tax going back a number of years. This has led to a credit on the Council Tax account which would normally be refunded. However, the LA have stated that they will use this credit to offset an HB overpayment…is this lawful? The client has already won their HB overpayment appeal at tribunal but the LA have asked for a SoR.

Nope…it’s not lawful.  Hard to believe they don’t know that.
