Is any one aware of any case law regarding those who occupy a dwelling as “property guardians” and their entitlement to Housing Benefit? Have a tribunal pending, the appeal response submits that my client is to be treated as not liable to make payments under various heads of Reg 9 HB regs.

don’t see that they would be paying rent, they are not tenants, at best licensees - surely.

No reason therefore why HB should not be paid on the basis of a liability to make payments “in respect of, or in consequence of, use and occupation of the dwelling” [Reg12(1)(d)]
