Choses in action which include a house and possible disregard of house as part of the chose in action
Please help!
Client’s mother died leaving him money and her house in her will. Probate took a while as usual and house was put on the market and subsequently sold by executors. Client was not executor. PC have decided inheritance was chose in action and valued it for the whole period of administration on the basis that the market value of the house (plus the money). Can we argue the usual capital disregards while the house was on the market, etc to decrease the value of the chose in action for a period of 26 weeks (or longer).
