Good morning

My client - a UK national - has been refused HB on the grounds that his partner - a Croat - doesn’t have an NI and won’t apply for one because an immigration lawyer has told her that is she applies for an NI it would be (i) illegal and (ii) detrimental to her immigration case.
I have no idea about the immigration advice but, in the absence of an NI number, is it legitimate to refuse HB?

Simply put I do not believe there is any requirement for her to have a national insurance number or even be applying for one.
