My client took her final exam on 21/05/12 and has been jobseeking since. She claimed JSA on 21/06/12 but was refused due to still being a full-time student. Term did not finish until 05/07/12 but she was not required to attend after her exams.

Obviously she can make a fresh claim now, but any comments about the decision?

How old is your client?  If she is under 20 she is treated as a ‘qualifying young person for child benefit purposes’ until the relevant terminal date (in this case 31 August). 

Otherwise she is counted as being a FT student until the ‘date on which the last day of the final academic term falls in respect of the course in which the student is enrolled’  (Reg. 130 JSA Regulations); which I interpret to mean 5/7/12.
