IS for people on ‘Credits Only’ IB.- did I miss something?

A very helpful lady at DWP has just told me that people who are on ‘Credits Only’ IB and whose capital or income has now fallen below the applicable amount for IS can no longer claim IS, they apparently have to claim ESA instead and will probably have to undergo the usual medical etc.

Has there been a news story or an announcement about this, I can’t remember seeing anything (but then again I’m old, tired and it’s Friday)

Any help gratefully recieved!

Hi Pete

Clients in receipt of incapacity credits only, rather than in receipt of IB itself, are unable to make a new claim for IS, and thus have to claim ESA instead.  This came in in Dec 2009.

People already in receipt of income support on basis of incapacity credits (from before Dec 2009), can continue to qualify for IS providing there is no break in claim.  (see p.351 of CPAG).

Thanks for that, I seem tio have spent the last two years doing ESA appeals and i’m beginning to wonder what else has slipped by me!
