IIDB appeal - asbestos-related condition

Hello everyone. I’m helping a cl with an IIDB appeal. Cl worked in the plumbing industry stripping asbestos off large boilers and has been diagnosed with multiple bilateral pleural plaques “consistent with previous asbestos exposure”. I argued he has a diagnosis of D9 (diffuse pleural thickening), but DWP response argues his diagnosis of multiple plaques does not meet the D9 criteria. I’m not a medic, but it seems a bit semantic, but maybe I’m wrong? Any help from more specialist advisers would be most welcome, thanks, Sarah

I have taken this to appeal. It really is quite specific about what constitutes Plural thickening and Plural Plaques is a separate thing. Do you have their x ray or a report from their specialist?

HI as a specialist adviser in asbestos related condition, Pleural plaques are not a compensable condition under the IIDB system. If the plaques come together to thicken the lining of the lung then it is D9. The tribunal will want to see x ray/ct scan on a disc from the hospital and any medical reports so if you are considering taking forward to appeal I would start getting them together.
On another point please check the plaques (asbestos fibres) have not come together to cause fibrosis of lungs (scarring) if so you are looking at D1
