Elliot Kent - 27 April 2016 12:08 PMMr Finch - 27 April 2016 11:55 AMClient requested a reconsideration. A response was received acknowledging ‘your recent request for a reconsideration’, informing her that as she has not supplied any new evidence, the decision cannot be changed.
I would be inclined to treat that as an MR and file an appeal straight away.
Yes, it’s been done. I anticipate some problems with HMCTS, and I can imagine unrepresented claimants trying to get through an endless cycle of internal DWP disputes before giving up.
I am collating these examples and the ones here - http://www.rightsnet.org.uk/forums/viewthread/9669/ - to send to operational stakeholders to highlight the ongoing problems…

This is getting silly. I’ve just had a DM from the new FEPS team in Kilmarnock forcing an explanation down my throat in an attempt to dissuade me from appealing against one of their decisions.
I am aghast!

Daphne
We have a case where a person has received a letter which says -
“We have looked again at our decision.
We have looked again at the facts and evidence we used to make our decision and looked at the points you raised. However, we have not changed our original decision
What happens now
Your reconsideration request will be sent to our Disputes Resolution Team who will look at the decision again.”
Only one copy, no reference to right of appeal which, presumably, they will only say arises once Disputes Resolution Team have made THEIR decision
I can fax or email copy with client details removed ,if that would help
Thanks
Brian
I will chase up my email and add in your example Brian - no need for client details at moment but will come back to you if they ask for them.

The title actually struck me as almost literally kafka-esque.

Colleague’s case today.
PIP - enhanced rate daily living awarded prior to renewal/review. Cl diagnosed with schizophrenia and other m/health problems and alcohol misuse. Claim terminated as cl failed to attend face-to-face consultation without good cause….
Reason for non-attendance? She moved address a couple of days before the appointment letter was sent out and did not inform PIP so did not receive the letter. Fully explained circumstances in request for MR.
The MR decision? Another “we have taken account of the information you have provided and the points you have raised. However, we have not changed our decision” rubber stamp of the ooriginal decision.
I cannot use the words on here that I would like to use for these people.
