Income related vs Contributory
A client is living alone with no income/capital and in receipt of contributory based ESA £65.45. This equals their applicable amount and were it not for the previous contributions record they would receive income related ESA of £65.45.
Would they be entitled to claim a Community Care Grant as their income related entitlement equals their contributory?
I can see the point you’re making but unfortunately while income-related ESA is a “qualifying benefit” for the purposes of CCG eligibility contributory based ESA is not.
I think the justifying “rationale” for this is that a claimant has to pass a limited income/capital test to qualify for income-based ESA whereas its possible to be paid contributory based ESA irrespective of the level of your other income or your savings.
In a similar vein - although they wouldn’t get a CCG they are eligible for free prescriptions etc under the Low Income Scheme
