Notice pay from the Redundancy Payments Service on employer’s insolvency
As usual the RPS has deducted benefits received during the Notice Pay
(and would have deducted any replacement earnings).
I cant see the legal basis for this.
s184(1)(b) ERA 1996 requires payment by the fund of statutory notice pay
due under s86(1), not payment of common law damages for breach of contract.
Any thoughts?
Is there anything in Harvey on the RPS and notice pay as I cannot access it for now.
