Furlough when someone has resigned
Hi
Can someone clarify, if someone resigned from their work after 28/02/20, does the employer that they resigned from have to put them on Furlough?

Employers don’t have any obligation to furlough people in any situation, it isn’t cost neutral and taking on someone who has resigned can lead to some messy employment law issues as it can be continuous service and you would then have to dismiss them. Also holiday continues to accrue and isn’t covered by the HMRC scheme.

Ok thanks. The problem I am having is that the DWP have advised this individual that the employer should furlough them and not claim benefit?

So what?
The employer doesn’t need to furlough people just because it would avoid the DWP needing to pay them benefit.
The claimant doesn’t have any control over whether their former employer now decides to take them back on just to furlough them.
The DWP doesn’t have any power to police whether or not people are furloughed.
They might as well have said “Have you tried asking Richard Branson to wire you some money so that you don’t need to claim benefit?”.
