Prosecuted for Fraud - did not appeal
I’ve just seen a client and helped her to complete a new claim form for DLA. She was in receipt of HRM for approximately 10 years - she was working in the evenings reading to residents in a residential home and DWP decided to prosecute her for fraud.
She was prosecuted on 16/09/10 and found not guilty.
The problem is her DLA was stopped when the fraud investigation first started approximately 14 months ago and she did not appeal due to all the upset with the prosecution.
I know i’m probably flogging a dead horse - but does anyone have any sugestions regarding the missing 14 months worth of benefit?
Any grounds for an any time revision for official error? This could give full backdating if it succeeds e.g. if the DM misinterpreted the law or ignored relevant information about the nature of the work. If it is as clear-cut as it seems, you could have grounds.
