Provision to end powers that enable local authorities in Wales to determine whether to comply with duties to assess and meet care needs during Covid-19 outbreak

New statutory instrument

New regulations have been issued in relation to the suspension of the requirement for local authorities to comply with duties to assess and meet care needs in Wales introduced by the Coronavirus Act 2020.

In force from 22 March 2021, the Coronavirus Act 2020 (Suspension: Local Authority Care and Support) (Wales) Regulations 2021 (SI.No.316/2021) suspend the operation of section 15 of, and Part 2 of Schedule 12 to, the 2020 Act which together modify duties of local authorities in Wales in relation to adult social care under Parts 3 and 4 of the Social Services and Well-being (Wales) Act 2014 so that local authorities do not have to comply with duties in relation to meeting needs, and carrying out assessments. As a result of the new regulations, the 2020 Act provisions will no longer have effect in Wales.

NB - under section 88(3) of the 2020 Act the provisions are however still capable of being revived at a later date.
