Severe Disability payable when not liable for Bedroom Tax as son at University?
My client is in receipt of IR ESA and Middle Rate Care DLA living in 2 bed social housing. Son has just gone off to Uni - so she is protected from imposition of bedroom tax. I believe that despite this she should still be eligible for Severe Disability Premium as she is now living alone. Does anyone have any experience of this or guidance as the position seems unclear? I’m rather hoping she can have her cake and eat it…...
I had a similar case recently and SDP was paid.
From memory and without looking it up, you get the SDP if you meet normal rules and no non-dep aged 18+ ‘normally resides with you’. BT exemption is for students provided they are away for less than 52 weeks and ‘intend to return home’.
So there is no contradiction between the 2 sets of rules; cake can be had and eaten.
