I have been asked to advise someone who is currently suspended from work since April awaiting a misconduct hearing, as his work requires him to have a licence and the licence has been suspended along with the employment his employer is not paying him while he waits for the hearing. He claimed JSA and has been signing on however DWP have so far refused to pay him stating that he is in full time work.  Is this correct?

I see where the DWP are coming from as he is still employed, and they probably dont believe he is genuinely looking for work anyway, as he is waiting for outcome of disciplinary.

Normally (unless on zero hours contract) the employer will continue to pay wages during suspension until the disciplinary outcome?

Have you looked into his working conditions/disciplinary procedure on his contract of employment?
