Here’s a question which may be obvious but is confounding me at this late hour of a MOnday - couple claiming JSA but she has put in medical certs from GP and is on DLA. Was initially told she was exempt from work seeking requirements. Now being told it was only for 4 weeks and they need to claim ESA instead. However, according to CPAG handbook this can continue indefinitely. (P.70)
I’ve been looking at some Regs and that exemption seems to have been revoked by The Social Security (Miscellaneous Amendments) (No. 5)
Regulations 2010 SI 2010 No. 2429 Paragraph 4, unless they have been claiming since before 2010 and therefore have protection.
Can someone clarify this for me as i am going round in circles?
The aversion to ESA, apart from the obvious reason, is that they get a disability premium with JSA but will have to do the 13 weeks assessment phase without an additional element if they go on to ESA- and he is actively seeking work.
