I have a client who has just been assessed as being 20% disabled, and thus recieves IIB. However he is no better off in financial terms, as his Income Based JSA has been reduced in consequence.

I cant find if a disability premium can be paid on the grounds of disability on the JSA claim. CPAG seems to suggest that attendance needs because of an injury at work is an equivilent qualifying benefit. I dont know if this means “constant attendance allowance” rate or if I can use it to get the disability premium in payment.

Has anyone any ideas?

Doesn’t count towards a disability premium but…............no benefit cap!
