Recovery of HB from partners (now deceased)

Hi, I’ve got a case where the HB was in Mr X name and there was an overpayment.  In 2009, the claim was transferred into Mrs X name and as they were a couple both at the time the overpayment occured and at the time of it’s recovery it began to be deducted from her.  In 2010 Mr X died and the recovery continued.

Can anyone advise on whether the overpayment would still be recoverable from Mrs X after the date of Mr X death as they would no longer be considered to be partners?

Thank you so much for your advice.  I just need to confirm the exact date of Mr X death and will then write to HB.  I will update further when I receive a reponse.
