Natural Migration and SDP TP for a couple

If 2 people both in receipt of SDP in ESA move in together as a couple, would they get SDP TP? Both currently live with parents and moving into rented accommodation so would need UC for rent costs.

Yes in theory. The checks are:
1. The claimant isn’t forming a couple with someone already on UC
2. The claimant was entitled to IS/ESA/JSA with the SDP in the month prior to the claim
3. The claimant continued to meet the conditions of entitlement to the SDP up to the date of the UC claim.

All of these conditions are met for both claimants so the TP should be paid.

In practice, it might be sensible for them to hold off claiming UC for a couple of days and instead put one of them onto the other’s ESA award and get the double SDP in place then claim UC in order to avoid headaches.

Great, thank you, I thought it would be best to do the joint legacy first and suck up a weeks rent but wanted to double check if they didn’t do that would they be entitled to SDPTP. Thank you for your help.
