DHP, which LA is responsible

Hi All

Client is in TA in LA2 having been placed here by LA1.
Gets UC for HC’s and has arrears for property in LA2.
Has applied for a DHP from LA2 who say that it is LA1’s responsibility.

I see that this has been discussed before in thread

In that thread, this is said

“6.5. If your LA makes an out of borough placement and the claimant is entitled to HB, the placing authority will pay the HB and consider the DHP.

6.6. If your LA makes an out of borough placement and the claimant is required to make a claim for UC housing costs, within the area that they have been placed. The LA where the claimant is now living and claiming UC housing costs should consider the DHP. This is because the allocation of DHP funding is based on the caseload data within each LA area.

However, when I look at the DHP guidance manual I can’t find these quotes or even a 6.5 or 6.6.

What am I doing wrong?

Looks like the manual has been updated.

I found this earlier version and that does contain the statement I previously posted but under different numbering also (4.2 et seq).

Thanks Paul

So the Eastleigh 2018 version appears to include a good practice guide.

I’m wondering if that’s what’s missing from the current DHP Guidance Manual.

I can’t see a current good practice guide?

Client needs to request review of LA2’s decision and the previous (2018) quote was perfect for this but I suspect LA2 might say that current guidance does not include this.

Just for reference, the manual as it stood from Feb 2021 until about April 2022 or so, is archived here, it includes those quoted sections.

But as noted, you can’t really ask an LA to follow out-dated guidance.
