I have not dealt with many prisoners so I would be grateful if anyone had any thoughts or observations on this case.

Cl served a short term (eight weeks) in prison (convicted and sentenced, not on remand) and their ESA was stopped in March of this year. They are now home again , bailed pending appeal of the original conviction. They have not claimed any benefits

I assume that as the ESA award has stopped it will trigger a move to UC ( I can’t find anything to say that ESA can just be reinstated if the cl is convicted) but if the appeal succeeds and the conviction is quashed then the Cl could have their ESA reinstated up to the point that they claim UC.

The cl. is in the ESA Support Group so would the LCWRA element be added to the UC from day one ( even though the ESA payments have ended) or would the WCA process have to start again ?

Would the LCWRA be added automatically only if the conviction was quashed as the cl would then have been getting ESA with LCWRA on the date they claimed UC?
