If a pensioner reaches 66 but his wife is 65. She will get her pension in 6 months. She is disabled but until now has refused claiming DLA. Her husband get DLA HRC. My question is, if they delay their claim for PC until DLA MRC or HRC is in payment to her. Would they have to migrate to UC or claim PC.
Is either of them currently on ESA(ir), JSA(ib), IS or HB?
Yes and PIP HRDLA, HB and CTS.
[ Edited: 27 Sep 2020 at 10:34 am by Terry Craven ]If she claims PIP (rather than DLA) now it will likely be more than six months before she gets a decision by which time they will both be pension age and will not be eligible for UC anyway.
Thanks, for this, if they fail to submit a claim for PIP say for 8 weeks. It is paid subsequently. Then it’s likely the couple will qualify for. PC opposed to UC. Is this correct.
If by some miracle PIP assess her quickly and she is awarded this prior to turning pension age she would have to make a claim for a legacy/working age benefit i.e irESA/ibJSA as they are a mixed aged couple and cannot make a claim for pension credit even with the double SDP in place
