Cold Weather Payment backdate after successful appeal
My question is simple but I cannot find definitive answer:
After successful appeal awarding qualifying benefit back over a period where cold weather payments would otherwise have been paid does a person get the payment?
- if they qualify for the benefit for one day during that period then yes so clear cut should get it
- however, is it on principle of say a crisis loan in that it is paid at the time of the cold weather therefore time has passed and no payment due but what if have electricity arrears etc.
Anyway, I cannot see it in legislation in black and white anywhere - can someone point me to this please.
Thanks in advance.
Emma
Found it - I’ve been looking for this all afternoon yesterday
SFCWP (Gen) Reg 2(6)
You can get the payment if within 26 weeks of last day of cold weather and change occurred which meant should have qualified.
Sorry for wasting anyone’s time.
