Carer Premium, mixed age couple carer earns too much.

Hi

I’ve just done a benefit calc for a mixed age couple.
Younger partner earns over earnings limit for carers allowance and there’s no entitlement to UC.
CTC is including a carer premium.
Is there provision for the the premium to be paid in these circumstances? I can’t find anything yet to support that but it seems logical.

When you say the carer premium is included in CTC, do you mean in HB? there is no carer premium in tax credits.
Which benefits are they moving from?

FYI there is no earnings limit for the carer element in UC, so your UC calculation should include the carer element in the maximum award, if eligible.
Also to think about - would the disabled member of the couple be entitled to LCWRA after a WCA - and would this increase in the UC max award lead to entitlement to UC? This would mean that a UC claim could be kept live with an entitlement of £0, pending a WCA.

I meant CTS not CTC.
In this case the older partner would, if AA awarded, be entitled to LCWRA.
LCWRA plus carer element for partner leads to an award of UC worth about £22 per week.
If LCWRA removed from calc, no UC awarded but council tax support awards about £30 per week.

I wasn’t expecting CTS to include a carer premium (without a UC award and with earnings in excess of limit) under these circumstances and I’m wondering if this is to do with pension age versus working age scheme, just can’t find anything definitive.

Reg.9 of the Council Tax Reduction Schemes (Default Scheme) (England) Regulations 2012 is clear the carer premium is awarded only if a Carer’s Allowance award is in place.

I don’t think it can be right that the carer premium is included in the CTS pension-age scheme calc if someone is not entitled to CA.

This is because in The Council Tax Reduction Schemes (Prescribed Requirements) (England) Regulations 2012, Schedule 2, Part 3, Para 9, it says the condition for the carer premium is that the carer is entitled to CA -

I’ve emailed the ben calc supplier to have a look at why it’s coming up.
