how can you get a copy of a migration notice letter?

client lost their migration notice letter and so we dont know the date they had to claim by.

they have made a uc claim but not been given transitional protection. I got them to put a note on the journal asking for a copy but to my surprise….they say they cant access that?  I had just assumed they would know this.

if they are correct in this and they cant access it, where do I signpost the client to get one?

uc know the date the tax credits ended as they have said that and the clients uc claim started the next day so I am sure they have made it before the final deadline at least but without the notice I cant be 100% sure.

I can’t see how the UC claim could have been made after the final deadline and still begin the day after tax credits ended.

I would therefore be comfortable in assuming the claim was made before the final deadline.

Have they definitely been given no TP, or could it just be that they haven’t calculated it yet? (We’ve seen quite a few cases where the calculation is only being made after the end of the first AP, particularly if the UC claim was made close to the final deadline. I should say though that it has been a bit better recently.)

thanks charles. I cant see a way they have missed it either.

their 3rd assessment period is about to end and no TP on the claim.

Do you have access to their UC statements?

Is there a line on their statement from their first AP saying “Transitional protection - £0.00”?

That is normally the way to check if they’ve made the calculation, but decided that the claimant is not entitled to any TP.

If it’s not there, it normally means that either they haven’t calculated it yet or that they believe that no qualifying claim for UC was made in time for them to consider TP.

I have asked them to have a look at this. thanks for this as thats given me something to look out for in future claims.

my suspicion again is that it hasnt been looked at. I got them to copy and paste a very specific note saying with the 2 dates they do have that we cant see how a claim wasnt made in time and then that as a disabled worker tp would be due and if not can they explain why….the response was they need the date from the migration notice to be able to check this for them.

its made me question if they dont have it….who actually sends them out to clients?

I had a similar case recently with a client who had “lost”  their UC MMN and forgotten deadline date
I rang the UC MM helpline ( 0800 169 0328) who advised that if the customer calls them ( with NINO and subject to passing usual security checks )  they can confirm what the deadline   date is/was

When I rang my client to advise this she had found her letter so we did not need to make the call but just to let you know this may be a way of   finding out the deadline date

do you know if they can just confirm the date or can they send a copy of the letter?

I know I should be used to this by now but its still managing to amaze me that its this difficult to get a copy of a letter sent to claim a DWP benefit by the DWP.

you can only admire the creativity to continue to amaze me after all this time.

I’m not sure I follow why the notice itself is so critical, given that it is just a standard document other than the dates, but surely if it has been retained it would be available on a DSAR.
