Carer’s Element after death of relative

I have a tenant that was previously caring for her father, and receiving both Carer’s Allowance and Carer’s Element of UC.
Sadly, her father passed away back in November.

Carer’s Allowance subsequently stopped, and is obviously no longer being deducted from UC.
However, the Carer’s Element is still paying out.

I know UC will continue to pay certain elements for another two assessment periods following a death, however this is now six periods down the line.

Am I missing something?
This is being paid in error, right?

Hi

  The award is to continue to be calculated as if the person had not died for the assessment period in which the death occurs and the following two assessment periods.

Universal Credit and Carers Allowance do not seem to be linked in the way I would have expected. I have had clients who were receiving Carers Allowance and this was been deducted from UC, however they were not getting the Carers Element.
When we approached UC they stated the Carers Element is not automatically paid to those in receipt of UC who receive Carers Allowance but that they have to declare of a Change of Circumstances that they are a full time carer ( they also need to do this on occasions to ensure that they are put in the No Work Related Requirement’s Group).
It seems your case that UC may not be aware she is no longer a full time carer and she would need to report a Change of Circumstances asap to prevent a further overpayment.

Just dealt with a very similar scenario, although the carers element had continued on for 2 additional months. There is an expectation by UC (or by the UC computer) that you report that you have ‘stopped caring’ in the very specific changes of circumstance box that relates to ‘caring responsibilities’, even if you have told them elsewhere about the person’s death.

In my case, the husband had sadly died, and all other aspects of the UC had ‘run on’ for the correct period.

In my view, if you have used the ‘Tell us Once’ service that should suffice ... how can you possibly still be caring for someone after their death. How insulting and distressing to the bereaved person to be forced to complete a ‘stop caring’ declaration months after UC already know the person has died. They should do it behind the scenes once they know that one fact about the death, and not expect the person to work out all of the implications for different aspects of the UC award.

What does ‘Tell us Once’ mean if not .... just ‘tell us’ the once ????

Recoverable overpayment but UC should be asked to use discretion to ‘waiver it’ but each request to waiver is a battle

We did go through the “Tell us once” process when her father died, and all other benefits stopped as and when they should have, but this element remained.

I wholeheartedly agree, having to force a grieving daughter to submit a “stop caring” change of circumstances again is rough going, and pretty indicative of how broken the UC system is.

Thanks for the responses folks, the fight to waiver this overpayment will now commence.
