JSA waiting time for Self Employed?

Hello,

I was asked yesterday how long a person would have to wait until they could claim JSA if they ended their self employment.  It’s been a long time since I’ve looked at this but I vaguely remember there being a fixed time; was it 6 or 12 or more weeks? before a person would be able to claim.  I searched high and low but am unable to find any such restrictions.  Can anyone help me please?

hi

i think you might be thinking about R(JSA) 1/09 where claimant had been disallowed jsa on basis that said to DWP that normal breaks between self-employed contracts were 12 weeks.  DWP had said that could make claim at end of twelve week period.

Judge Rowland allows claimant’s appeal and sets out detailed guidance on how to decide if claimant is still in remunerative work -
