Offsetting UC/pension credit
I saw some previous posts about the apparent inability to offset arrears of ESA against UC and I was wondering in anone has any experience of the procedure with PC.
Cl has been on UC for some time and then reached PC age. SRP was paid right away but five or six weeks after claiming there is still nothing from PC.
UC has continued but with a deduction for the SRP ( not a full SRP, cl has not been in the UK long enough to get the full amount)
At the risk of sounding naive I would have said that, logically, any arrears of Pension Credit would be offset by the amount of UC already paid but the thread regarding ESA and UC makes me doubt that!
If there is an overlap between UC and PC who gets the money back, UC or PC? I need to prepare my cl for this as they are very very anxious about being overpaid and are really struggling with the whole concept of UC and the sooner they go onto SRP, PC and HB the better
Why are they still receiving UC? It sounds like they’re single and if that’s the case UC is currently being overpaid if they’re past the assessment period with their birthday in (which seems to be the case).
It would therefore be the UC that’s overpaid as PC is due and owing.
(I had a similar case last year where UC didn’t end for months after state pension age - it just added to an already complicated case that’s only just been resolved.)
Thanks for the reply, we are waiting to see what UC make of it, they can hardly say they didn’t know that the cl had passed Pension Age , the significant birthday is a fact already known to them and there was also a bit of a clue when they started to deduct State Retirement Pension?
I know that there is no legal avenue to make any overpayment non- recoverable but I still hold out hopes that the overpaid UC will be deducted from arrears of PC which is more or less where I started with this thread
Wouldn’t it be an idea to close the UC award down at least? That way you can make a HB claim and stop any overpayment increasing?
That is in progress, UC have realised the mistake but we have yet to hear what they are going to do. PC are very delayed so there is an issue that the cl will be without money.

Any UC overpayment currently includes housing costs as well so it’s getting larger than it needs to be.

A certain Mr Manville has had to chivvy the Pension Service along with a couple of LBA’s to good effect.
