If someone is in receipt of war pensioners’ mobility supplement (overlaps with PIP mobility component), can they also claim the daily living component of PIP? Would such a claim jeopardise the war pensioners’ mobility supplement entitlement?

Thank you.

This may be relevant and though it didn’t have a conclusion, you could always contact the member to find out what happened in that case.

He went to Tribunal and was awarded ERDL/SRM. Despite it being clearly outlined to it, in my submission and again at the hearing, DWP went merrily ahead and paid the Mobility component and backdate, as predicted by mickd123. A non-recoverable overpayment was therefore generated before PIP realised the error of its ways and politely asked my client if he would be so kind as to pay it back? He said, thanks for asking but no. It did not repeat its mistake when the award was renewed. I can’t recall the ins and outs of the Regs now but as far as I remember there never an issue with the DL part of PIP and the particular WP components he was receiving.

Some of the legislation is here, don’t know if it is of any help https://www.gov.uk/government/publications/the-armed-forces-compensation-scheme-and-service-pensions-order-legislation/the-armed-forces-compensation-scheme-and-service-pensions-order-legislation#the-armed-forces-and-reserve-forces-compensationscheme-order-2011-si-2011517
