Receipt of DLA HRM (no care component) was over 65 April 2013 - has extensive care needs - DLA Supersession or AA?

Section 64(1)(A) SSCBA 1992 would allow an application for AA.

Any thoughts on pros and cons and how do the DWP actually treat a AA application for a client in receipt of DLA HRM in practice?

I’d probably go for the DLA supersession as we’ve seen cases before where people have tried to claim AA in similar situations and DWP have treated that as supersession application anyway and sent out another set of DLA forms.

I’ve had similar just recently for a client and they phoned DLA to report need for care award, form sent out for completion and then new award made (after MR off course with no additional evidence provided!)

DLA supersession is the way. He gets hi mob, so if AA claimed then he would lose mobility?

No DLA Mob and AA can be paid at the same time.
