failure to disclosed because not too ill too deal with own affairs
A client had a hearing for a P.C overpayment for failing to disclosed an private pension. The tribunal adjourned the hearing and asked the client to get a letter stating what his illness is and how it effected him. Also advised him to get a rep.
We have the letter, which supports him but I cant find the case law or regs which cover this situation.
Any advice/help welcome.
