ESA to UC
I have a client who is living with parents. Moving to own tenancy and will be living alone. Ha DLA care component and no one gets CA.She would therefore have entitlement to SDP after moving. Am I right in thinking if she moves and notifies ESA of the change of address and gets the SDP she can then claim HB and will avoid having to claim UC?
As long as it’s middle/high rate care rather than low rate (when it won’t work) then yes, that exactly!
Yes, I am going to double check awards, but seems like an option that should work in this case. Thanks.
According to post 122 in this thread https://www.rightsnet.org.uk/forums/viewthread/13872/P120 you don’t need to wait until SDP is in place to claim the HB. It is enough to be on ESA and meet the conditions for SDP to be excluded from claiming UC and therefore entitled to claim HB. How responsive you will find local authority I have no idea.
