Change of circumstances whilst living in temporary accommodation
Hi
I would appreciate if someone can clarify the following:
Someone is living in temporary accommodation in a full service area and in receipt of JSA and also HB. If they have a change of circumstances (that would normally trigger UC), would they remain on HB as the live in in temporary accommodation but also have to claim UC due to the change of circumstances to a legacy benefit?

Yes but it would have to be a change of circumstance that would have necessitated a claim for a legacy benefit - eg they have a child and would have had to claim CTC for the first time, or they fall sick and would have had to claim ESA, or become a carer and would have claimed IS - can’t think of anything else that might apply - there may be but the key thing is it much be a change that would have meant a legacy claim
Yes. People in temporary accommodation are allowed to make new claims for HB, but not any other legacy benefit (unless they have three dependent children). If they need to make a new claim for ESA, IS or WTC/CTC then they will have to claim UC instead.
People in this situation can continue to get HB at the same time as getting UC, UC just won’t include anything for housing costs.
