Just double checking this one- Cl. is already getting CB- ESA at assessment rate but now needs to claim IR-ESA to get the SDP added. They are in a full service area. As we know IR ESA and CB ESA are part of a single benefit and as far as I can see cl. is in fact only notifying a change of circs ( employer has stopped paying contractual sick pay) rather than making a new claim. Would filling in an ESA 3 trigger a claim for UC instead of IR ESA ?
No he will be assessed as IR ESA no need for UC claim.
Thanks, that what I thought but sometimes you look at these things and begin to doubt your conclusions…....
This only works if he is on old-style ESA (e.g., ESA awarded before full service roll-out, or has 3+ children). If it’s new-style ESA, then no income-related components can exist.
Thanks Jon, he’s on old style ESA, the area only goes full service from today
Colleague came up with this as there were some concerns re: a ESA 3 being completed in relation to IB to ESA (IR) retrospective claims.
‘I spoke with a decision maker within DWP last week about the whole IB-CB ESA situation. There was a worry that those on CB ESA would be unable to get their SDP/ESA now we are full service, however, the decision maker has confirmed that putting in an ESA3 will not trigger a UC claim, it is simply a review of the current claim. So anyone who is on a CB claim and the claim was made prior to Nov 2017, they can complete an ESA3 and they will get their premiums.’
