Hello

Does anyone know what information service users will need to provide in order to qulify for the two bedroom rate of LHA?

Does it have to be a paid carer?

Guidance was issued to LA’s in A3/2011

The circular talks about the medical need for the care and paragraph 34 talks about unpaid carers.

There are essentially 3 tests.
1) There is actually an extra bedroom used by the care giver.

2) There is a medical need for overnight care as evidenced by; DLA, AA etc.

3) Care is actually being provided. This is where the guidance says that the LA can ask for whatever evidence it thinks necessary to satisfy itself that care is provided. It suggests that LA’s should ask for a care plan from social services or something from a private care provider.
