Work Allowance applied if you are in your waiting period for WCA?

Hello comrades,

My client has been on UC waiting for WCA since July 2016.  He completed his UC50 in October but not yet called to WCA.

He has had an opportunity to do a short term bit of admin work (10 days) on a self-employed basis.  He will need to report this to UC and because it is a one off and not the sort of work he usually does and is registered self-employed to do (Director) we hope he will not be found gainfully SE.

I can’t figure out whether the work allowance should be applied or whether he would need to have been found to have limited capability for work first.  Can any one shed any light?

Also I note that government plan to get rid of WA for those with LCA by April 2017 - please say it ain’t so?

There was a backbench motion in favour of delaying the work allowance cut, but I don’t think that has any real effect:

LCW element will be going for new claims but the work allowance for those with LCW will be staying ( as far as I know.)

Many thanks all - so just to be clear, he wont have a work allowance applied to his UC claim as long as he hasn’t been found to have a limited capability for work?

If he is then subjected to the WCA and found to have limited capability for work for the period, should his UC award be adjusted to reflect the work allowance (presuming this all happens before april - a real hypothetical I know).
What if this happens several months down the line?

My understanding is that if you are assessed as having LCW it is only the LCW element that is stopped for new claims after April 2017 - the work allowance still applies - see this thread http://www.rightsnet.org.uk/forums/viewthread/10744/ - so you don’t get extra UC but you can earn more before you lose it. Similarly you get lower level of conditionality.
