Residence allowance as income
Can anyone clarify for me the treatment of residence allowance as income in a HB claim. I am finding conflicting information in various sources.
One says it is counted up to the childs personal allowance and any above is disregarded
Another says it is counted in full for HB

Residence Order Allowance was taken as income up to the amount of the childs personal allowance for working age claims for HB. It was disregarded in full for HB for pensioner claims.
New regulations come into effect from April 2011 which extend the disregard and it will be disregarded in full for all HB claims.

can you point me to the reg which states it is disregarded from april as our HB section have said they are still counting it up to personal allowance?

Hi Di, it was reg 2(10) of the The Housing Benefit and Council Tax Benefit (Miscellaneous Amendments) Regulations 2010, SI 2010 No 2449.
You can also refer then to parts 27 to 31 of the HB/CTB circular A19/2010 which spells it out more clearly for them.
