Hello

Tenant cares for her mother who only gets the low rate care component and high rate mobility of DLA. She has been getting this for a physical condition for a long time but has now been diagnosed with dementia and has substantially increased care needs. They put in for a supersession of DLA to get a higher rate of care in June but they are still awaiting decision. Tenant claimed IS at the same time on the basis of caring for someone who was waiting a decision on a claim ... but this has been refused.

I would assume that waiting for a decision on a supersession would be the same as waiting for a decision on a claim but can’t think of any other reason it would be refused as seems to fit the criteria.

Any thoughts?

I don’t think they are the same. 
I don’t think your client qualifies for IS at this stage.
