The sdp and people from abroad
My client is a single parent getting the sdp. Because she is so ill her Mum is coming from abroad on a visitors visa to stay with her to help with the children. Does anyone know if there is any caselaw about whether this means my client loses her sdp and if so at what point?
hi
cis/14850/96 has guidance on what normally residing means -
its in toolkit - http://www.rightsnet.org.uk/toolkit/income-support/
i think it sounds as though your client could argue that not living with daughter but has come on temporary basis to look after her and children with intention of returning home to where she ‘normally resides’. would help if she’d maintained her own accomodation in her home country.
cheers ros
Thank you - thats really helpful - so next problems. Do you think her mum’s is arrival a relevant change of circs so she needs to inform dwp and do things change if mum puts in an application for indefinite leave to remain.
