Client is Dutch national who was on JSA for over 2 years. She recently got sectioned, the JSA claim has been stopped and JCP advised client to claim ESA, which I believe she won’t get as her only r2r was as a jobseeker.
Although she was in hospital for just under 2 weeks, she is still very unwell and seems to have already informed JCP that she can no longer work, so I don’t think there is much hope that the old JSA claim can continue.
I don’t really understand the recent changes for EEA nationals, but from what I can work out:
It seems pretty clear that HB will be gone for good (or until worker status is acquired and retained), or is there a way out.
And for reclaiming JSA in the future, would that still be possible?  I can’t find any changes to the JSA regulations apart from the 3 months rule.  And regarding the changes to jobseeker definition in EEA regs, I suppose her period of sickness has not changed the fact that she entered UK initially as a work seeker, but what about the 6 months?
Any ideas anyone?

Do a JSA28 for the first two weeks of sickness as you said it was not quite two weeks. If she needs another one do that as well, this will buy you a little time.

Just do JSA28 pdf in google, print, fill in and send to local JCP or take by hand.
