Urgent query - 16 year old A8 national

We have a client who is 16, parent has apparently returned home with younger sibling. 16 year old wishes to stay in UK and continue education but is homeless (tenancy had been in parent’s name) so support worker querying if IS claim possible….........however I cannot see that estrangement applies here?

Client came to UK about some years ago, parental work history unknown at this stage.


All thoughts and advice appreciated!

Would you not need to think about right to reside and hab res before thinking about the estrangement bit?

Saturday morning job at Mcdonalds or anywhere would qualify as worker status with full access to Housing Benefit to pay the rent for a young persons project or bed-sit

If she was living with her parent at any time one of her parents was working here then that will take care of the right to reside (Teixeira).  Social Services probably have a duty to put a roof over her head and to see she doesn’t starve.  I can’t see the estrangement bit on the limited information given.  The Saturday morning job is an idea also.

Don’t forget retained family member right to reside under reg 10 EEA Regs and art 12 EC Directive 2004/38.
