Bedroom tax and death of someone in household before 1 April13

Hello
If someone in the household has died before the bedroom tax comes in, this April, and it was less than 12 months ago, does the protection from the bedroom tax apply? e.g. partner died 1 July 2012. Would they get protection till end of June 2013?

Am looking at the HB amendment regs 2012 about the bedroom tax (new 12BA) and cant work it out for certain.

Any ideas please

That’s how I’ve read it, and I’ve already fired a warning shot across the bows of our HB section for one of my clients who lost a household member in November.  HB appear to agree with me (for once), though they did squirm that it was still draft regs when I wrote to them.

One of the main problems is that the LA will not know…if the claim for HB is made via the DWP. Such information is not needed for social sector tenants at the moment (working excemptions, type of accommodation, joint-tenant families, number of rooms and so on are also relevant) but will become very important from April and August (when the Benefits Cap is now expected to go nationwide).
