Lull in self-employment - entitled to JSA?

Hi – just checking this:

Client is self-employed roofer but has had no work since mid-Feb. Has signed on for JSA pending further work but claim has been rejected as income exceeds.

He passed his last year’s accounts to JCP and they have calculated his income at £250 pw.

They accept he is not in work so he can continue to sign on but they are taking his income into account from the accounts.

Am I right in thinking that this is a correct application of JSA Reg 95(1)(a) and that the only way he could avoid it would be if he declared that he was no longer self-employed?

Any alternative views welcome.

No, they should look at whether the alternative approach under 95(1)(b) would be more accurate.

And as they are letting him sign on for credits I assume they accept he isn’t in remunerative work at present?

I’ll give it a bash.
