How do I stop a non-dependant deduction?

I have a client who is on IS and is in receipt of full HB and CTB. She has had on going problems with HB and CTB through no fault of her own.

Her eldest daughter has just turned 18 and is currently at sixth form. She is going to University next year. The client has provided information that the daughter is at school still.

She will not get the student exemption certificate from the university until September. In order to avoid a non-dependant deduction what information should the client give to housing and council tax benefits until she can provide an exemption certificate?

As far as I am aware students continuing in education should not attract non-dependant deductions during the summer holidays when they transfer from sixth form to University.

Any help would be much appreciated.

isn't your client getting child benefit for her? i'd expect her to be treated as a dependant until terminal date in September.

I have just received a letter from the council advising that they have applied non-dependant deductions for 2 other children over summer holidays. If someone is between sixth form and university should a non-dependant deduction still be applied? As far as I am aware during university vacations non-dep deductions should not be applied but is this the same between college/sixth form and university.

Please help as when I phoned the council they stated they need details of whether the children were working, yet all the information I have states that students (even if working during vacation) should not attract a non-dependant deduction.

None dependant deductions only apply if the student is working during the holidays HB Reg74(7) HB Regs;reg 55(7)HB (SPC) Regs.

Yes its official Im bored as not yet piked up any casework from BAP (Braunstone Advise Project) so resorting to answering pots on rightsnet.
