from latest issue of dwp's hb direct - 'The Commissioner decided that HB regulation 70 (Rent free periods) did not apply to the case before him as, although required to pay 23 fortnightly payments of rent, the tenant was liable for their rent throughout the year.
Therefore, the annual rent is required to be calculated and rent allowance paid over 52 weeks. We have been made aware of the potential effect of the Commissioner’s decision in the above case on the claims where the tenancy is on similar terms to that in the case.
We have been considering our response to it. Recent emails from local authorities affected by the decision have brought the impact of it into sharper focus and we are looking at this issue as a matter of urgency.
We will come back to you as soon as a decision is made on the way forward. In the meantime, if you have any information on how local authority and housing association tenancies deal with rent free weeks, in broad terms, that would be appreciated.
