Clmt left matrimonial home to live in rented accom. Tue 21-Feb-06 08:42 PM
Claimant has left her matrimonial home to live in rented accommodation. She separated from her husband in October 05 and is receiving Income Support for herself and her 4 children-her reasons for leaving her home was because her husband kept arguing with her and demanded rent from her. Marital home is in husband's sole name. Clmt submits that she has no interest in the property and never contributed towards the mortgage. She does not want to initiate any divorce proceedings. She has no idea if they will get back together .

Assuming that IS is being obtained lawfully, all income & cap is disregarded for HB/CTB. Therefore, I'm unclear why you anticipate there may be a problem in claiming. Is there more to this?
