Please help!
I have an appeal against an overpayment that was raised on the 6th April 2006, covering the period September 05 to Feb 06. The Housing Benefit was paid to the landlord, but the overpayment has been deemed recoverable from the claimant because they failed to notify the authoirty that their entitlement to child benefit had ceased in September 2005. The claimant has appealed.
Our notification to the claimant states that the overpayment is recoverable and that should their entitlement to hb cease they will be invoiced. The landlord's notificaiton states that the overpayment "is to be made recoverable from your tenant".
Therefore the notifications dont appear to meet the requirements set by A13/2006.
I am now at the stage where I am sending this to the Tribunals Service, is there anything I need to do regarding the notifications before I take it forward?
any advice re A13/2006 would be appreciated!
