Attendance Allowance/DLA Care when entering a Care Home

Can anyone confirm that when a client with AA/DLA Care enters a Care Home funded by a local authority the AA/DLA Care ends after 28 days?

This was my understanding but a colleague recently was advised by the AA unit that AA/DLA Care ends from day 1 of Local authority funding?

If it does end on day 1 has this always been the case or when did the rules change?

The general rule is that DLA care/AA stops after 28 days in LA funded residential care; or 84 days for children under 16. This doesn't apply to retrospective self-funders and can also be muddied by linking period for those who regularly leave and enter care - usually children or those needing frequent respite.

You would be wise to obtain a copy of Disability Alliance's 'Disability Rights Handbook' or CPAG's 'Welfare Benefits and Tax Credits Handbook' for dealing with these questions. Both of these publications are updated annually. Don't be tempted to use the same book for several years...
