Stayed Housing Benefit Overpayment Appeals

Had a HB overpayment appeal this morning, was stayed apparently the president of the tribunal's service made this announcement yesterday, which is that ALL housing benefit overpayment appeals be stayed, the chair agreed it was daft as it is seeens to be something to do with the recent TOC's case and our case has nothing to do with recovery from landlords...

Does anyone know if leave to appeal has been granted against the TOC's decision?

Cases are still stayed.

The President stayed all overpayment appeals for the three month period prior to going on leave, the reason behind the three month stay is that is the maximum time allowed to seek leave to appeal to the CoA

Not absolutely all HB overpayment appeals seem to be stayed, as I heard a few 2 weeks ago!

My client has just heard from the Tribunal Service, so it would appear TOC dec CH/4234/04 has now been resolved... for now. At least we can now move on with all o/p appeals as most of my clients have had to put up with recovery action whilst these cases have been stayed.

I'd suggest an ombudsman complaint if recovery is made while an appeal is in progress, even if stayed.
