Non-dependant deduction and abolition of hospital downrating
Thu 23-Feb-06 09:43 AM

I understand that the non-dependant deduction ceases to be applied after 52 weeks in hospital...

But will the forthcoming abolition of 52-week downrating of IB/IS have any effect on this, or will things stay as they are?

The new consolidated HB regs still state no NDD after 52 weeks in hospital (now reg 74). A bit early to have to start amending the new HB regs if this is not going to be the position but who knows.

Thanks for that - I'll keep an eye out for any change, but if the new HB regs still say 52 weeks, that's good enough for me.

Does the concept of linking rules still apply to periods in hospital when calculating the 52 week period (and 28 day period for AA?)?

Amended HB/CTB regs state if distinct periods are separated by intervals not exceeding 28 days then periods spent in hospital are aggregated. Not sure any changes have been made re AA?
